Terms & Conditions – Swim Clean Pool Service

Welcome to Swim Clean Pool Service Inc. These Terms & Conditions apply to all residential pool services in Toronto and York Region, including pool opening, maintenance, and closing. By booking or using our services, you agree to the following terms, which are designed to ensure transparency, fairness, and a high standard of service.

1. Basic Responsibility of Pool / Property Owners

To provide services safely and efficiently, Swim Clean Pool Service requires:

  • Unobstructed access to the pool, pool equipment, and surrounding area. Locked gates, construction, stacked furniture, or pet waste may be considered obstructions. Please notify us in advance of any temporary access issues.
     

  • Power availability: All pool-related circuit breakers inside the house must be on.

  • Backyard power: Access to a working power outlet (receptacle) is necessary.
     

  • Water access: A working garden hose or water supply valve must be available.
     

  • Water level maintenance: Homeowners must maintain pool water between midway and three-quarters of the skimmer. Failure may result in additional billable visits.
     

  • Skimmer basket maintenance: Daily cleaning is required to maintain proper circulation. Swim Clean Pool Service is not responsible for damage or extra cleaning resulting from neglect.
     

  • Safe access around the pool: Overhanging bushes, shrubs, or unsafe conditions may result in additional charges or service delays.
     

 

2. General Service Terms

  • Health & Safety: Swim Clean Pool Service may refuse service if a property is unsafe for staff or clients.
     

  • Equipment & Chemicals: We may not use client-supplied chemicals unless they are clearly labeled, safe, and accessible (directly near pool equipment or in plain sight). Chemicals with worn or faded labels are not accepted.
     

  • Local Bylaws: Homeowners are responsible for backyard fence and gate compliance. Swim Clean Pool Service is not liable for intrusions, injuries, or property damage related to non-compliant fences or gates.
     

  • Weather & Delays: Service times are estimated; delays may occur due to weather or equipment issues. We will notify clients when possible.
     

  • Cancellations & Rescheduling: Clients may reschedule with 24-hour notice. Late cancellations or inaccessible properties may incur fees.
     

  • Liability Limits: Swim Clean Pool Service is not responsible for damage caused by pre-existing defects, owner neglect, weather events, or vandalism. Liability for negligence is limited to the value of the services rendered.
     

 

3. Pool Opening Terms

  • Required Accessories: Skimmer baskets, return jets, ladders, and other pool items must be available prior to service. Missing or damaged items may require additional billable visits.
     

  • Service Scope: Essential opening package does not include vacuuming. Complete opening package includes 1 hour of vacuuming; additional time billed at $100 + HST per hour.
     

  • Minor Repairs: Repairs under $100 + HST may be completed at the time of service to ensure circulation and filtration, and will be billed accordingly. Swim Clean Pool Service will communicate these issues at the time of opening.
     

  • Chemical Treatments: Initial brushing and shocking are included as specified. Follow-up chemical balancing may be required for green or neglected pools.
     

 

4. Pool Maintenance Terms

  • Skimmer baskets will be cleaned during each maintenance visit. Homeowners are responsible for daily cleaning.
     

  • Water level must remain midway to three-quarters of the skimmer.
     

  • Filter pumps must run a minimum of 12 hours per day.
     

  • Inclement weather may require chemistry checks rather than full cleaning; additional billed visits may be necessary.
     

  • Maintenance visits after October 1st incur a $10 + HST surcharge.
     

 

5. Pool Closing / Winterization Terms

  • All accessories required for winterization (water bags, winter plugs, covers) must be available prior to arrival. Missing items may result in additional billable visits.
     

  • Pools closed after October 31st incur a $50 + HST per week surcharge, with freeze-damage liability remaining with the homeowner.
     

  • Clients must monitor water bags installed on tarp covers within 72 hours; follow-up visits after this period are billable.
     

  • Autocovers: Swim Clean Pool Service recommends safety or tarp covers. Homeowners using an autocover assume responsibility for water levels and potential damage.
     

 

6. Billing & Payment Terms

  • All services and products are billable unless explicitly noted.
     

  • Discounts or credits are at Swim Clean Pool Service’s discretion.
     

  • A credit card on file is required for scheduling.
     

    • Weekly clients are billed monthly after services are rendered.
       

    • Non-weekly clients are billed immediately upon service completion.
       

  • Late payments (30+ days) incur 2% per month interest.
     

  • Service pricing may increase due to pool size, complexity, additional features, or inflation.
     

 

7. Well Water Disclaimer

  • Pools using well water may experience minerals, metals, pH variations, staining, or scaling.
     

  • Swim Clean Pool Service is not responsible for well water-related issues. Chemical treatments are based on conditions at the time of service only.
     

 

8. Service Termination

  • Swim Clean Pool Service reserves the right to pause or terminate services for clients who do not comply with these Terms & Conditions.

These Terms & Conditions apply to all Swim Clean Pool Service clients in Toronto and York Region, covering pool opening, maintenance, winterization, and billing. Our goal is transparency, safety, and high-quality service.
